This Agreement (“Agreement”), together with the associated policies accessible on our website, sets out the terms and conditions applicable to your use of the services and website located at radiologyprime.com (“Website”). Please read this Agreement thoroughly and ensure you understand its contents — it forms a binding legal contract between you (the User) and Radiology Prime.
By accessing or using the Website, you acknowledge and agree to be bound by the terms and conditions of this Agreement, including any future amendments or revisions notified to you in accordance with the Changes to this Agreement section below. If you do not agree with these terms, you should cease all use of the Website.
Your continued use of the Website signifies your explicit consent to be legally bound by this Agreement and any updates made to it. We will notify Users of significant changes; it remains your responsibility to review the Agreement periodically.
This Agreement is governed by, and construed in accordance with, the laws of Portugal. Any disputes arising from the use of the Website are subject to the exclusive jurisdiction of the Portuguese courts, without prejudice to mandatory consumer protection rights available to you under the laws of your country of residence (see Governing law and jurisdiction below).
In the event of a breach of these terms, Radiology Prime aims to address such matters fairly and constructively, while reserving all rights available under applicable law. These terms and conditions, together with the Privacy Policy, the Cookie Policy, and the Medical Disclaimer, represent the full agreement between you and Radiology Prime regarding your use of the Website.
Service availability and geographic scope
The Radiology Prime platform is offered to patients resident in any country other than Portugal. The service is not offered to residents of Portugal.
Where the service is offered, eligibility is also subject to the operational availability set out at the point of upload — including any country-of-residence confirmation in the checkout flow — and to your acceptance of this Agreement.
If you are not resident in an eligible jurisdiction, you must not submit imaging, personal data, or payment details through the platform. Radiology Prime reserves the right to decline or cancel any case submitted from an ineligible jurisdiction, and to refund payment in accordance with its refund policy.
Users are responsible for ensuring that accessing and using the service complies with the laws and regulations of their own country of residence. Radiology Prime makes no representation that the service is appropriate or lawful for use in any specific jurisdiction.
About Radiology Prime: a technology platform, not a medical practice
Radiology Prime is a technology platform operated by a business registered in Portugal. The platform facilitates a connection between Users and an independently licensed Reviewing Radiologist for the sole purpose of obtaining an independent specialist neuroradiology second-opinion review of previously acquired diagnostic imaging.
Radiology Prime does not practise medicine. Radiology Prime is not a healthcare provider, does not employ physicians, does not diagnose medical conditions, and does not issue radiology reports in its own name. The platform provides the technology, secure infrastructure, and administrative framework through which Users submit imaging and receive radiology reports prepared by an independent Reviewing Radiologist.
The Reviewing Radiologist is an independent medical professional, licensed and regulated by the competent medical authority of their own jurisdiction, and is solely responsible for the content, accuracy, and professional quality of any radiology report they provide. Radiology Prime does not direct, control, review, or otherwise influence the professional judgement of the Reviewing Radiologist. Accordingly, Radiology Prime accepts no liability for the content of any radiology report, subject to the limits imposed by applicable consumer protection law.
As at the date of this Agreement, the platform’s Reviewing Radiologist is the Clinical Lead, a consultant radiologist (Facharzt für Radiologie) with sub-specialty focus in neuroradiology, registered in Germany. As the platform’s reviewing team grows, additional Reviewing Radiologists may be engaged in other jurisdictions. Any such additions will be disclosed on the Clinical Lead & Medical Review page and reflected in updated versions of this Agreement and the Privacy Policy.
How the service works
The platform enables a User to submit existing diagnostic imaging — MRI or CT studies of the brain, spine, or head and neck — together with any accompanying clinical information and questions, in order to obtain an independent specialist neuroradiology second-opinion review from the Reviewing Radiologist. The review process involves the Reviewing Radiologist analysing the submitted images and producing a written radiology report setting out their independent professional observations within their sub-specialty scope.
It is the User’s responsibility to have first obtained a primary interpretation of their diagnostic imaging from their treating healthcare professional. The second-opinion service reviews studies that already have a primary radiology report from the User’s own imaging provider; the platform does not provide first reads of unreported imaging.
The second-opinion service is intended to supplement, not replace, the care provided by the User’s treating physician.
Each service package includes up to three follow-up questions for the same case. If additional follow-up reports are required, the User must purchase a new package.
No doctor–patient relationship is established through the platform
By accessing and using the platform and any radiology report received through it, you acknowledge and agree that no doctor–patient relationship is created between you and Radiology Prime, and no licensed-medical-practitioner / patient relationship is created between you and the Reviewing Radiologist by your use of the platform itself.
The interaction with the Reviewing Radiologist through the platform is a discrete, case-specific second-opinion review and does not establish ongoing medical care, clinical responsibility for your overall condition, or any obligation on the part of the Reviewing Radiologist to provide continuing advice or treatment. You remain under the clinical care of your treating physician at all times.
You understand and agree that Radiology Prime is not responsible for any actions, decisions, or outcomes resulting from your reliance on the information provided through the platform.
Medical disclaimer and scope of service
The radiology report provided through the platform is based solely on the imaging materials and clinical context you submit, and represents the independent professional interpretation of a licensed Reviewing Radiologist at the time of review. It is intended to support — not replace — the clinical assessment of the treating physician responsible for your care.
The Reviewing Radiologist delivers a clinically informed second opinion based on the image quality, technical parameters, and clinical context provided at the time of submission. As with all radiological review, findings reflect the available image data and the independent professional judgement of the Reviewing Radiologist.
This service does not constitute medical advice, a clinical diagnosis, or a treatment recommendation. Radiology reports should not be acted upon without consultation with a qualified healthcare professional who is responsible for your overall care. Radiology Prime does not provide clinical guidance, endorsement of treatments, or therapeutic recommendations of any kind.
For best clinical outcomes, all radiology report findings should be discussed with your treating physician before any healthcare decision is made.
Delivery of reports
The User acknowledges and agrees that radiology reports will be delivered through the platform and / or by email as a PDF attachment. By using the service, the User consents to receiving reports by these methods.
Users are encouraged to ensure that the email address associated with their account is secure and accessible only by them, and to store received reports appropriately.
Privacy and medical data
Radiology Prime processes medical imaging and associated Personal Data uploaded by Users for the purpose of facilitating the specialist neuroradiology second-opinion service. By uploading medical imaging and clinical information, Users provide explicit consent to the processing of their Health Data for this specific purpose under GDPR Article 9(2)(a).
Radiology Prime is the Data Controller for platform-level processing. The Reviewing Radiologist acts as an independent Data Controller for clinical record-keeping and professional liability purposes in their own jurisdiction.
Uploaded imaging is stored on the platform for a limited period following delivery of the report and is then securely deleted. Users are encouraged to upload only imaging and clinical information directly relevant to their request and to avoid including unnecessary personal information.
Full details of how Personal Data and Health Data are processed, transferred, retained, and protected are set out in our Privacy Policy, which forms part of this Agreement.
Registration
As part of the registration process, you will be required to provide your name, a valid email address, your country of residence, and to create a password. By registering, you confirm that you are resident in an eligible jurisdiction as set out in the Service availability section above.
Your credentials serve as your unique identifier for accessing the service. It is essential that you maintain the confidentiality of your credentials and refrain from sharing them with anyone else. By keeping your credentials private, you significantly reduce the risk of unauthorised access to your account and personal information.
Radiology Prime is not responsible for any misuse or unauthorised access resulting from the sharing of your credentials. If you suspect any unauthorised access to your account, please notify us immediately. We reserve the right to suspend or terminate your account if we have reasonable grounds to believe that your credentials have been compromised or misused, or that the account has been opened by a User resident in an ineligible jurisdiction.
Payment, billing, and refunds
Payment authorisation
By using the service and providing your payment details, you agree to pay all charges associated with your selected service package, in accordance with the payment terms applicable at the time of transaction. Submission of your payment details authorises Radiology Prime to process the applicable charges.
Any subsequent billing will be communicated in advance and processed only in accordance with your selected package terms. Where changes to billing are required, users will be notified in compliance with applicable consumer protection legislation.
Pricing
Radiology Prime reserves the right to revise its pricing for new purchases. Where pricing changes affect existing users or active service packages, reasonable advance notice will be provided, in line with applicable consumer protection legislation in the User’s country of residence. Continued use of the service following notification of pricing changes constitutes acceptance of the revised terms.
Secure payment processing
All payments are processed through Stripe, a PCI-DSS certified payment processor. Transaction data is encrypted in transit and is not stored on Radiology Prime’s servers. While these technical and organisational safeguards are designed to reduce the risk of unauthorised access, no digital system eliminates all security risk, as noted in the Risk mitigation section below.
Refunds and consent withdrawal
Under GDPR, you have the right to withdraw consent to the processing of your Health Data at any time. Please note the following regarding the interaction between consent withdrawal and service delivery:
- Before the Reviewing Radiologist has begun review, you may withdraw consent and request deletion of your uploaded data; in such cases, a full refund of the service fee will be provided.
- After the Reviewing Radiologist has begun review, withdrawal of consent will result in the closure of your case without delivery of a radiology report. Because professional services will already have been rendered in part, the service fee may be non-refundable at that stage, at Radiology Prime’s reasonable discretion and in line with applicable consumer protection law.
- Your consumer rights under the laws of your country of residence (such as statutory rights of withdrawal from distance contracts under EU Directive 2011/83/EU and equivalent UK legislation) remain unaffected by this clause. Where a statutory right of withdrawal applies, it will be honoured in accordance with the applicable law.

Risk mitigation and awareness
Radiology Prime employs current security technology and operational practices with the aim of maintaining a responsive and well-governed connection between Users and the Reviewing Radiologist. Despite these efforts, as with any digital or internet-based service, there are inherent risks involved in using the platform. These risks, although uncommon, could potentially include:
- Instances where transmitted information is insufficient for review, such as cases involving low-resolution images or incomplete clinical context
- Possible delays in delivery of a radiology report due to unforeseen technical or equipment issues
- Interpretive limitations in cases where access to the User’s complete medical history or prior imaging is not available
- The use of industry-standard network and software security protocols that, while designed to safeguard Health Data, cannot guarantee absolute protection against all security events
- Occasional software, system, or technology updates that are essential for maintaining service standards but may cause temporary service interruptions or modifications
- Submitted imaging that includes findings falling outside the Reviewing Radiologist’s specialist neuroradiology sub-specialty scope, in which case Radiology Prime reserves the right to decline the case or to deliver a report addressing only those findings within scope. Sub-specialty areas explicitly outside scope include musculoskeletal, urology and gynaecology, cardiothoracic, breast imaging, body oncology, and emergency presentations.
Radiology Prime is committed to minimising these inherent risks through current security technology and documented operational practices. However, as the factors above indicate, no internet-based service can eliminate all potential points of failure. These limitations are transparently disclosed so Users can make informed decisions about their use of the service.
Security protocols
Radiology Prime applies multi-layered administrative, physical, electronic, and organisational safeguards — reviewed in line with current EU data protection standards under GDPR Article 32 — aimed at protecting User data against loss, misuse, or unauthorised alteration. These measures are designed to maintain the confidentiality and integrity of Personal Data and Health Data in our possession.
Our infrastructure is hosted on Google Cloud Platform within EU regions, with encryption in transit (TLS 1.2+) and at rest (AES-256). Full details of the security measures applied to your data are set out in our Privacy Policy.
As disclosed in the Risk mitigation section above, no digital security system can provide an absolute guarantee against all forms of breach or failure.

None of the content provided on the Website or the platform should be construed as medical advice or as an endorsement, representation, or warranty that any particular medication, procedure, or treatment is safe, appropriate, or effective for you. The information, materials, and content available on the Website or platform are for informational purposes only and should not be relied upon as a substitute for professional medical advice.
Radiology Prime makes no representations or warranties regarding the accuracy, completeness, or reliability of the Website or platform content. Any reliance you place on such information is at your own risk. Radiology Prime disclaims any liability for actions taken or decisions made based on the Website or platform content without consultation with a qualified healthcare professional.
Disclaimer of warranties
Acknowledgment of risks and limitations
You expressly acknowledge and agree that your use of Radiology Prime’s website, platform, and any radiology reports received through it (collectively, the “Services”) is at your sole risk. The Services are offered on an “as is” and “as available” basis.
Limitations on use of radiology reports
You expressly understand that radiology reports received through the platform are intended to support, and not replace, the clinical relationship between you and your treating healthcare provider. Radiology reports are not intended for use in legal proceedings of any kind, including but not limited to medical malpractice, professional liability, insurance claims, or workers’ compensation claims.
No warranties
To the fullest extent permitted by applicable law, Radiology Prime disclaims all warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, title, operability, condition, quiet enjoyment, value, accuracy of data, and system integration. Nothing in this clause excludes or limits any warranty or right that cannot be excluded or limited under applicable consumer protection law.
Independent medical practitioner
Radiology Prime does not employ the Reviewing Radiologist. The Reviewing Radiologist is an independent medical practitioner who uses the Radiology Prime platform to deliver radiology reports to Users. Any professional observation or opinion contained in a radiology report comes from the Reviewing Radiologist alone, and not from Radiology Prime.
Radiology Prime, its affiliates, and any third parties associated with the platform are not liable for the content of any radiology report, subject to the limits imposed by applicable consumer protection law.
Sub-specialty scope
The platform operates within specialist neuroradiology — MRI and CT review of the brain, spine, and head and neck across six sub-capabilities (neuro-oncology, demyelinating diseases, neurodegenerative diseases, congenital anomalies of the brain and spine, head and neck imaging, and vascular diseases of the head, neck, and spine). Where submitted imaging includes findings outside this sub-specialty scope, Radiology Prime reserves the right to decline the case or to deliver a report addressing only those findings within scope.
The Reviewing Radiologist’s opinion within sub-specialty scope remains their own independent clinical judgement.
Informational scope only
All services provided through the platform are for informational purposes and to support clinical decision-making by your treating physician. They do not constitute professional medical advice, diagnosis, or treatment directed at you by Radiology Prime. Always seek the advice of a qualified healthcare professional with any questions or concerns about your medical condition.
Limitation of liability
To the fullest extent permitted by applicable law, Radiology Prime and its associated personnel, directors, and affiliates bear no responsibility for any indirect, incidental, consequential, or special damages, including but not limited to loss of profit, data, goodwill, or clinical outcomes, arising out of or in connection with your use of the services, regardless of the legal theory applied.
Nothing in this Agreement excludes or limits Radiology Prime’s liability for:
- death or personal injury caused by Radiology Prime’s negligence
- fraud or fraudulent misrepresentation
- any liability which cannot lawfully be excluded or limited under applicable consumer protection law in the User’s country of residence
In jurisdictions where limiting liability is restricted by law, Radiology Prime’s liability will be confined to the minimum extent mandated by applicable law.
Service availability: commitment and known limitations
Radiology Prime endeavours to maintain the availability and functionality of the platform but does not guarantee that the services will be uninterrupted or error-free. Radiology Prime reserves the right to temporarily suspend or modify the platform at any time for maintenance, upgrades, security, or other operational reasons.
Governing law and jurisdiction
This Agreement is governed by the laws of Portugal. Any legal proceedings arising from or in connection with the use of the Website or the services provided through it shall be brought before the competent courts of Portugal, without prejudice to any mandatory consumer protection rights available to you under the laws of your country of residence.
If you are a consumer resident in the European Economic Area or the United Kingdom, you may also bring proceedings in the courts of your country of residence, and you benefit from the mandatory consumer protection provisions of the law of that country where those provisions are more favourable to you than Portuguese law.
Changes to this Agreement
Radiology Prime may update this Agreement from time to time. Material changes will be notified through the platform or by email prior to the change becoming effective. Continued use of the platform after the effective date of any update constitutes acceptance of the updated Agreement. Users who do not agree with the updated Agreement should cease using the platform.
